Unlike players in the NFL, who are paid handsomely and who some may argue have accepted the risk of a concussion or head trauma as a potential occupational hazard, players in the NCAA© are not compensated. However, the NCAA© and participating schools take in millions of dollars every year from ticket sales and endorsement deals. While the NFL© has recently taken steps to establish a fund for medical examinations, research, player monitoring, and compensation for players suffering from the effects of a concussion, the NCAA© has not followed suit. Essentially, this means that unpaid student athletes are currently at greater risk than their professional counterparts.
According to plaintiffs in a recent NCAA© head injury lawsuit, the organization failed in its duty to protect student athletes, and though earning considerable profits from these players' efforts, has not established proper guidelines for dealing with concussions. NCAA© players are young adults whose brains may still be developing, yet the NCAA© currently has no official policy or guidelines for the treatment of head injuries or for the monitoring or suspension of an athlete who has suffered a head trauma or concussion.
As stated in a recent ESPN article, nearly one-half of college trainers who participated in a survey by concussion expert Robert Cantu in 2010 stated that they have put athletes back into the game when they are showing signs of concussions. This greatly increases the risk of subsequent concussions, as well as a condition known as secondary impact syndrome, which can cause blood loss to the brain leading to potential neuropsychological issues, learning difficulties, and even an increased risk of future strokes.
